					</table>The U.S. International Trade Commission (<a href="https://www.usitc.gov/home" target="_blank" rel="noopener">ITC</a>) has terminated an investigation into the global provider of utility-scale wire (solar, electrical balance of systems) solutions company <a href="https://www.voltageenergy.com/">Voltage</a>’s patent infringement through its LYNX trunk bus solution.
The investigation cleared Voltage of violating ITC’s Section 337 for importing and selling its trunk bus solution.
<a href="https://shoals.com/" target="_blank" rel="noopener">Shoals Technologies Group</a> initiated the investigation in May 2023, accusing Voltage of infringing on its patents, including its big lead assembly technology for trunk bus solutions.
The investigation termination follows earlier dismissals of claims that Voltage infringed on two other patents on trunk bus solutions and in-line fuses.
Voltage said it introduced its trunk bus solutions to the market in 2019, four years before Shoals&#8217; patent was issued in June 2023.
In September 2024, Shoals received a favorable ITC ruling in its patent infringement complaint against Voltage. Shoals had issued two new patents covering Shoals’ BLA technology, U.S. Patents 12,015,375 and 12,015,376, in addition to the &#8216;153 (U.S. Patent 11,689,153) patent that Voltage was found to violate.
In November 2024, the Commission issued its notice determining the judge&#8217;s initial determination to review. It declined Shoals&#8217; request to review the finding that Voltage&#8217;s alternative LYNX design does not infringe Shoals&#8217; patent. However, the Commission examined whether Voltage&#8217;s LYNX design can continue to be imported.
According to investment bank ROTH Capital Partners, the decision effectively reversed the administrative law judge’s initial determination and found no violation. It said approximately 87% of similar Section 337 cases result in a final determination that upholds the initial determination.
It added that Shoals recently filed a new Section 337 case to broaden the language to allow new patents to be applied to alternative and existing designs.
The new lawsuit is projected to take 12-18 months to file. The latest trial is expected to begin in October/November 2025, and the initial determination is expected in the first quarter of 2026.
There has recently been a <a href="https://www.mercomindia.com/patent-disputes-soar-topcon" target="_blank" rel="noopener">surge</a> in intellectual property disputes involving clean energy companies, especially those related to TOPCon solar technology in recent months, particularly in China, Europe, and the U.S.
In April 2024, Maxeon Solar Technologies, a Singapore-based solar solutions provider, <a href="https://www.mercomindia.com/maxeon-patent-infringement-claims" target="_blank" rel="noopener">filed</a> infringement claims against Canadian Solar, REC Solar, and Hanwha for violating three patents on TOPCon technology.

					</table>The Rajasthan Electricity Regulatory Commission (<a href="https://rerc.rajasthan.gov.in/" target="_blank" rel="noopener">RERC</a>), in a recent order, has rejected the compensation claims by a solar developer for losses incurred due to voltage fluctuations and directed them to make necessary arrangements for injecting or withdrawing reactive power per the regulations outlined by the Central Electricity Authority (<a href="https://cea.nic.in/" target="_blank" rel="noopener">CEA</a>).
The Commission also directed the Rajasthan Rajya Vidyut Prasaran Nigam (<a href="https://energy.rajasthan.gov.in/rrvpn/#/home/dptHome" target="_blank" rel="noopener">RVPN</a>), the state load dispatch center (<a href="https://sldc.rajasthan.gov.in/rrvpnl/" target="_blank" rel="noopener">SLDC</a>), and the solar developers to take appropriate and necessary action to maintain the grid voltage within the operating limits for 200 MW (2*100 MW) solar power projects at the Bhadla Solar Park in Rajasthan.
ACME Jodhpur Solar Power, ACME Rewa Solar Energy, and <a href="https://www.acmesolar.in/" target="_blank" rel="noopener">ACME Solar Holding</a> had filed a petition with the Commission requesting it to direct the respondents to comply with the Grid Code and take measures to overcome the issue of consistent voltage tripping at the 220 kV Bhadla substation and compensate the petitioners toward the loss of revenue.
The respondents included RVPN, SLDC, <a href="https://sauryaurja.com/" target="_blank" rel="noopener">Saurya Urja Company of Rajasthan</a>, <a href="https://nrldc.in/" target="_blank" rel="noopener">Northern Regional Load Despatch Center</a>, <a href="http://164.100.60.165/" target="_blank" rel="noopener">Northern Regional Power Committee</a>, and the Solar Energy Corporation of India (<a href="https://www.seci.co.in/" target="_blank" rel="noopener">SECI</a>).
Background 
ACME Solar Holding formed two special purpose vehicles (SPVs), namely ACME Jodhpur Solar Power and ACME Rewa Solar Energy, for the development of a 100 MW solar power project by each SPV at the Bhadla Solar Park, Phase-III in Rajasthan.
The projects supply power through a dedicated line connected to the Saurya Urja Company of Rajasthan’s 33/200 kV pooling substation, which is the interconnection point of the projects with the grid.
The pooling substation is connected to RVPN’s 400/220 kV grid substation through two 220 kV transmission lines.
The solar developers, in their submission, said since 2018, they had encountered severe voltage fluctuations at the Bhadla substation, resulting in abnormal tripping of solar inverters, damage to electrical components, and reduced power generation. The continuous under-voltage problems had hampered the generation process, preventing it from reaching its maximum capacity.
The petitioners contended that the grid disruptions and low voltage incidents at the Bhadla substation resulted from the absence of a secure and dependable transmission system, which was the responsibility of RVPN and SLDC.
However, despite repeated requests and acknowledgment of such events of grid disturbances involving voltage tripping, RVPN, and SLDC had failed to undertake measures to resolve such issues.
The petitioners had engaged Hitachi Energy India to conduct the steady state analysis and determine the cause for under voltage. According to Hitachi, the cause of the constant tripping was due to issues at the Bhadla grid substation.
Following this, RVPN officially approved installing a 500 MVAr transformer at the 400 kV Bhadla grid substation. However, despite receiving authorization in August 2022, there has been no progress on installing the transformer and STATCOM (Static Synchronous Compensator).
In response, RVPN explained that some tripping had occurred on the 220 kV line 1 (from the Pooling substation to the RVPN Bhadla substation) due to the activation of under-voltage protection by the Saurya Urja Company of Rajasthan. As of September 8, 2022, full solar generation had been recorded, and no further incidents of under-voltage tripping were observed.
RVPN also mentioned that on numerous occasions, the generator failed to provide reactive power to support the grid. Instead of assisting the grid, the generator had drawn reactive power from the grid when the grid voltage was low.
Saurya Urja Company of Rajasthan argued that considering the issues of over or under voltage on Line-01, the Commission should instruct RVPN to install STATCOM to enhance grid voltage during peak generation. This measure would prevent solar generators from experiencing energy losses and inverter tripping.
Furthermore, they requested the installation of two 25 MVAr shunt reactors to manage voltage conditions at the pooling substation connected to the main bus, with the associated development costs being covered by the solar power developers.
Commission’s analysis      
The Commission observed that the solar developers had raised the issue of grid disturbances at the Bhadla substation and requested a compensation of ₹58 million (~$697,177) for loss of revenue.
The Commission noted that dynamically varying reactive support by generators is necessary to ensure a reliable voltage level. Voltage and reactive power control significantly impact system stability, and an imbalance of reactive power, i.e., drawl during low voltage supply, can lead to voltage instability.
The state regulator noted that RVPN and Saurya Urja Company of Rajasthan had reported that the real-time reactive power injection and absorption support from the generator during under or over-voltage conditions did not meet the requirements of the CEA regulations.
It also directed the RVPN to commission the sanctioned +300MVAR, 400 kV STATCOM at 400 kV GSS Bhadla, and +100MVAR, 220 kV STATCOM at 220 kV GSS Phalodi.
It noted that the grid voltage should remain within the operating limits as specified in the CEA regulations, and the responsibility to maintain the grid voltage pertained to the solar developers, Saurya Urja Company of Rajasthan, RVPN, and SLDC.
In light of this, the Commission instructed the solar developers to establish suitable arrangements for injecting or withdrawing reactive power per the regulations outlined by the CEA.
According to the CEA, the generating station must be capable of supplying dynamically varying reactive power support to maintain power factor within the limits of 0.95 lagging to 0.95 leading.
As the petitioner shared most of the responsibility in this matter, compensation could not be awarded to the developers.
In June this year, CEA <a href="https://www.mercomindia.com/renewable-developers-must-comply-connectivity-rules" target="_blank" rel="noopener">directed</a> renewable energy developers who have applied for connectivity until April 30, 2023, to comply with CEA Connectivity Regulations by September 30 or face disconnection.

Rajasthan Rejects Solar Developer’s Compensation Claims for Grid Fluctuations

The Solar Energy Corporation of India (<a href="https://www.seci.co.in/" target="_blank" rel="noopener noreferrer">SECI</a>) has extended the deadline to submit bids for its tender for 2 GW of solar and 2 GW of wind projects.
The new deadline for the submission of bids for the 2 GW solar project is May 28, 2020. The earlier date for the <a href="https://mercomindia.com/seci-two-tender-solar-wind-projects/" target="_blank" rel="noopener noreferrer">submission</a> of bids was May 5, 2020, as previously reported by Mercom.
The bid submission deadline for the 2 GW wind project has been extended from May 6, 2020, to May 26, 2020. The interstate-connected (ISTS) solar and wind power projects have been tendered under tranche-IX of the ISTS program.
SECI had issued the request for selection (RfS) for both the projects in March 2020.
2 GW Solar Tender
Interested bidders are expected to pay a sum of ₹400,000 (~$5,299)/MW as the earnest money deposit (EMD).
A single tariff must be quoted by the bidder for its response to the RfS irrespective of the number of projects the bidder bids for.
According to the tender document, the successful bidder may modify the project configuration in terms of blocks following the issuance of the Letter of Award (LoA).
The project may consist of any number of blocks. The minimum voltage level for a single block will be 33 kV.
The scope of work for the 2 GW solar tender includes the acquisition of land, connectivity, and long-term open access approvals by the solar power developer.
The documents stated that applicants are allowed to submit a single bid for quantities between 50 MW and 2 GW in multiples of 10 MW.  The minimum project capacity per project is 50 MW, and the maximum is 300 MW. The total capacity that can be allocated to a single bidder is 2 GW.
The successful bidder will have to pay ₹100,000 (~$1,331)/MW/ project, including 18% goods and service tax (GST) to SECI.
2 GW Wind Tender
SECI issued its 2 GW of ISTS-connected wind projects for setting up the projects on a “build-own-operate” basis.
Earlier, a SECI official told Mercom that the wind tranche-IX 2GW was a retender of the previously announced <a href="https://mercomindia.com/seci-extends-bid-deadline-wind/" target="_blank" rel="noopener noreferrer">1.2 GW</a> wind tender. However, the capacity was increased to 2 GW.
Interested bidders are expected to make an earnest money deposit (EMD) of ₹600,000 (~$7,949)/ MW.
According to the document, the minimum project size will be 50 MW. A single bidder can be allotted a maximum capacity of 2 GW.
As far as the financial eligibility criteria are concerned, the net worth of the bidder should not be less than ₹12 million (~$159,767)/ MW of the quoted capacity as on the last date of the financial year (FY) 2018-19.
The bidder should have a minimum annual turnover of ₹5.7 million (~$75,889.4)/MW during the previous fiscal year.
In January 2020, Mercom <a href="https://mercomindia.com/seci-rfs-solar-tranche-viii-ists/" target="_blank" rel="noopener noreferrer">reported</a> that SECI issued another tender to set up 1,200 MW of solar projects under Tranche-VIII.
According to <a href="https://mercomindia.com/research-2/" target="_blank" rel="noopener noreferrer">Mercom India Research</a>, SECI has so far tendered 16.7 GW of ISTS solar projects under tranche I to X; and 13.4 GW of ISTS wind projects under tranche I to IX.

SECI Extends Bids Submission Deadline for its 2 GW Solar and 2 GW Wind Tender

The National Thermal Power Corporation (<a href="https://www.ntpc.co.in/" target="_blank" rel="noopener noreferrer">NTPC</a>) has extended the bid submission date of its 1 GW solar tender.
The tender was issued in <a href="https://mercomindia.com/ntpc-floats-tender-1-gw-solar-projects/" target="_blank" rel="noopener noreferrer">October 2019</a>.
The revised date for bid submission is now December 3, 2019, while the opening date of techno-commercial bids has been scheduled for December 4, 2019. Earlier, the deadline for the submission of bids was November 18, 2019, as reported by Mercom previously.
According to the NTPC, for 50 MW project, the amount of bid security to be deposited is ₹20 million (~$278,705) and ₹50 million (~$696,762) for projects in the range of 60 MW to 110 MW. Bidders who want to bid for projects between 120 MW to 220 MW, will have to pay ₹100 million (~$1.4 million). A bid security of ₹200 million (~$2.8 million) will be required for projects between 230 MW to 300 MW.
Interested bidders can bid for a minimum of 50 MW and in multiples of 10 MW. A single bidder can bid for a maximum capacity of 300 MW.
Further, the solar rooftop or floating solar projects, which are grid-connected, should also be considered eligible for qualification requirement purposes.
In recent months, NTPC, a government-owned entity, has floated several tenders for the development of solar projects across the country.
Recently, the NTPC had <a href="https://mercomindia.com/ntpc-extends-deadline-solar-cpsu/" target="_blank" rel="noopener noreferrer">extended</a> the bid submission deadline for 1,000 MW of solar projects under the Central Public Sector Undertaking Program Phase II, Tranche-1.
Before this, the company had to <a href="https://mercomindia.com/setting-upper-tariff-cap-ntpc-solar-tender/" target="_blank" rel="noopener noreferrer">extend</a> the bid submission deadline for its 1.2 GW solar tender in western India after an upper tariff cap set by the NTPC failed to attract bidders.
Then last month, <a href="http://tbeaindia.com/" target="_blank" rel="noopener noreferrer">TBEA</a>, a Chinese manufacturer of power transformers and other electrical equipment, bagged 300 MW of solar projects in the 1.2 GW auction conducted by the NTPC.
In August 2019, Mercom had <a href="https://mercomindia.com/ntpc-tender-solar-across-india/" target="_blank" rel="noopener noreferrer">reported</a> that the NTPC had issued a tender to set up 1.2 GW of the interstate transmission system (ISTS)-connected solar projects.
According to Mercom’s <a href="https://mercomindia.com/research-2/" target="_blank" rel="noopener noreferrer">India Solar Project Tracker</a>, NTPC has 874 MW of commissioned solar projects in the country.
