					</table>The Maharashtra Electricity Regulatory Commission (<a href="https://merc.gov.in/">MERC</a>) has proposed introducing a capacity-based banking framework for renewable energy generating systems irrespective of the procurement arrangement and mandating energy storage systems (ESS) for grid-interactive and behind-the-meter rooftop systems above 100 kW.
The draft Grid Interactive Rooftop Renewable Energy Generating Systems Regulations, 2026, state that any augmentation, enhancement or increase in the installed capacity of an existing renewable energy generating system will result in mandatory migration of the consumer to the proposed regulations from the date of such augmentation or enhancement.
The regulations will be applicable to net metering, net billing, group net metering, gross metering and virtual net metering arrangements along with grid-connected renewable energy systems with behind-the-meter arrangements.
Any renewable energy generating system arrangement availed by a consumer will have a minimum lock-in period of one year from the date of commencement of the arrangement.
Banking Framework
The draft proposes contracted capacity-based banking regulations for net metering, virtual net metering and group net metering arrangements.
The banking slot for a consumer will be determined by their cumulative contracted renewable energy capacity, irrespective of the procurement arrangement, including renewable energy procured through captive, open access, net metering, or virtual net metering.
Consumers with a contracted renewable energy capacity of up to 3 kW will be eligible for annual banking of surplus energy and would not be subject to banking time slots, fixed banking and standby Charges (FBSC) or variable banking and standby charges (VBSC).
Consumers with 3 kW to 10 kW contracted capacity will have a monthly banking framework and will be exempted from FBSC and VBSC. Consumers with contracted renewable energy capacity ranging from 10 kW to 100 kW will have monthly banking divided into four banking slots. Both FBSC and VBSC will apply to this category.
Consumers with contracted renewable energy capacities ranging from 100 kW to 1 MW will have eight banking slots, those with 1 MW to 5 MW will have 12 slots, and consumers with more than 5 MW will have 24 slots. Both FBSC and VBSC will be applicable to all three categories of consumers. FBSC will be levied on a ₹/kW/month basis on contracted renewable energy capacity, while VBSC will apply on a ₹/kWh basis to energy banked across different slots.
For prosumers with contracted renewable energy capacity above 5 MW, the quantum of energy permitted for banking will be capped at 10% of the energy consumption of the consumer during each banking slot. However, after three years from the date of the implementation of the regulations, such consumers will have to switch to 15-minute scheduling and no banking service will be applicable.
Energy Storage Requirements
All new grid-interactive rooftop renewable energy generating systems and behind-the-meter systems with a capacity higher than 100 kW must be equipped with ESS of 50% of the installed renewable energy capacity with at least two hours of storage. Consumers can also opt for storage systems with capacity equivalent to 25% of installed renewable energy capacity with at least four hours of storage.
MERC proposes a minimum ESS capacity of 1 kWh for every kW of installed renewable energy capacity up to 2030, increasing to 2 kWh/kW thereafter.
Consumers can also switch from one metering/billing arrangement to another twice during the validity of the relevant agreement. Any banked energy must be settled under the existing arrangement and cannot be carried forward to the new arrangement.
The cumulative capacity of renewable energy generating systems under net metering, net billing, group net metering and gross metering connected to a distribution transformer or feeder should not exceed 70% of its rated capacity.
Net Metering
The energy generated by the renewable energy generating station will be offset against the energy consumption of the consumer from the distribution licensee. If the quantum of electricity exported exceeds the quantum imported during the billing period, the difference will be carried forward to the next billing period as credited units of electricity.
If the quantum of electricity imported exceeds the quantum exported, the distribution licensee will raise its invoice for the net electricity consumption after adjusting the credited units.
The unutilized surplus banked energy will be considered as lapsed at the end of each banking period for consumers with contracted capacity higher than 3kW. The renewable energy generating station can get Renewable Energy Certificates to the extent of the lapsed banked energy.
For consumers with contracted capacity up to 3kW, distribution licensees can purchase the surplus banked energy at the at the rate notified by the Commission.
If the consumer is within the ambit of Time of Day tariffs, the electricity banked will be adjusted against consumption in the banking slots starting from highest to lowest energy charge.
In cases of group net metering, if the export of energy units during any billing period exceeds the imports at the connection, the surplus units injected into the grid will be adjusted against the energy consumed in the monthly bill.
Group Net Metering
Under group net metering, surplus electricity can be allocated to the consumer’s other electricity connections according to a predefined priority and sharing ratio. Energy adjustment will follow the applicable banking slots. Transmission and wheeling losses will be deducted in kind from surplus energy injected into the grid, while applicable transmission and wheeling charges will be levied on energy credited to the other connections.
Net Billing
Consumers opting for net billing will first use the renewable energy generated for self-consumption. Surplus energy injected into the grid will be credited at the approved generic tariff, while electricity drawn from the grid will be billed at the retail supply tariff.
Net billing consumers will not be eligible for banking of surplus energy.
Gross Metering
Under gross metering, the energy generated by the consumer’s system will be sold to the distribution licensee under a power purchase agreement. The distribution licensee will purchase the generation at the Average Power Purchase Cost for the relevant period, with the tariff remaining constant for the duration of the agreement. Gross metering consumers will not be eligible for banking of surplus energy.
Renewable Purchase Obligation (RPO)
The draft proposes that under net metering, net billing and behind-the-meter arrangements, the quantum of electricity consumed by an obligated entity will qualify towards RPO compliance. For non-obligated entities, the electricity consumed will qualify for the distribution licensee&#8217;s RPO compliance.
Under gross metering, the entire quantum of electricity recorded by the generation meter will qualify towards the distribution licensee&#8217;s RPO compliance.
In September, MERC <a href="https://www.mercomindia.com/maharashtra-proposes-grid-code-rules-for-battery-energy-storage-systems" target="_blank" rel="noopener">proposed</a> amendments to the State Grid Code to introduce operational, scheduling, data-sharing, and grid compliance requirements for battery energy storage systems and renewable energy projects.

Daily News Wrap-Up: PM Surya Ghar 2.0 May Mandate Energy Storage

The Maharashtra State Electricity Distribution Company Limited (<a href="http://www.mahadiscom.in/" target="_blank" rel="noopener noreferrer">MSEDCL</a>) has filed a petition before the Maharashtra Electricity Regulatory Commission (<a href="https://www.merc.gov.in/" target="_blank" rel="noopener noreferrer">MERC</a>) against its new Renewable Purchase Obligations (RPO) regulation.
In the petition, the DISCOM has made several requests to the commission &#8211;
<ul>
<li>To not levy penalty on non-compliance of standalone annual targets and cumulative targets of RPO until 2022-23</li>
<li>To allow MSEDCL to revise the ceiling tariff for solar tenders with capacities between 2-10 MW from ₹3.15 (~$0.04)/kWh to ₹3.30 (~$0.05)/kWh</li>
<li>To allow MSEDCL to purchase bagasse power with expired energy purchase agreements at the average power purchase cost (APPC) price or a tariff cap of ₹4 (~$0.06)/kWh</li>
<li>To allow MSEDCL to issue tenders with a combination of projects with expired EPAs and new capacities to encourage better participation</li>
<li>Allow MSEDCL to increase the ceiling tariffs for upcoming wind tenders</li>
</ul>
The MERC has said that the hearing of the case will be held on February 18, 2020.
In October 2019, MERC <a href="https://mercomindia.com/maharashtra-draft-policy-sets-solar-rpo-target/" target="_blank" rel="noopener noreferrer">issued</a> a draft policy announcing its RPO from 2020 to 2025. The solar RPO targets mentioned in the policy draft started at 4.5%, going up to 13.5% over the next five years. Following the draft announcement, MSEDCL <a href="https://mercomindia.com/solar-rpo-target-unachievable-maharashtra-discom/" target="_blank" rel="noopener noreferrer">suggested</a> revisions stating that the solar RPO target of 13.5% by 2024-25 was quite stiff and that despite efforts, it would not be able to achieve them. A total solar capacity of 12,500 MW would be required by 2024-25 to achieve the target while its current contracted solar capacity stands at 4,200 MW.
<a href="https://mercomindia.com/maharashtra-discom-wind-power-non-solar-rpo/" target="_blank" rel="noopener noreferrer">In December 2019</a>, the state DISCOM issued a tender to procure 200 MW of wind power on a long-term basis from intra-state wind power projects. The power procured from the wind projects would help MSEDCL fulfill its non-solar renewable purchase obligation.
Previously, Mercom reported that MSEDCL <a href="https://mercomindia.com/msedcl-wind-expired-agreements-rpo/" target="_blank" rel="noopener noreferrer">had filed a petition</a> with the MERC seeking its approval to procure power from wind projects whose energy purchase agreements have expired to fulfill its RPO.
RPO is the single most important policy driving renewable energy installations in India toward achieving the aggressive goal of installing 175 GW by 2022, with solar comprising 100 GW of this portfolio. Despite the ambitious targets, RPO <a href="https://mercomindia.com/states-new-solar-rpo-target/" target="_blank" rel="noopener noreferrer">compliance</a> has not been up to the mark.
The MNRE has <a href="https://mercomindia.com/mnre-creates-rpo-compliance-cell/" target="_blank" rel="noopener noreferrer">created</a> a compliance cell for RPOs. The cell will coordinate with states, the central electricity regulatory commission (CERC), and state electricity regulatory commissions (SERCs) to ensure RPO compliance.

Maharashtra DISCOM Does Not Want to be Penalized for Non-Compliance of RPOs

The <a href="https://www.merc.gov.in/">Maharashtra Electricity Regulatory Commission</a> (MERC) has directed the Maharashtra State Load Despatch Center (MSLDC) to amend its forecasting and scheduling procedure in line with the rules and principles of the commission within two weeks.
The commission has also asked the MSLDC to undertake stakeholders’ consultation for the draft amendment and submit the amended procedure after considering the stakeholders’ comments for approval within 45 days.
The commission has noted that there are specific challenges in implementing the MERC Forecasting and Scheduling Regulations as raised by various petitioners. Forty-three renewable energy generators filed a petition along with Maharashtra State Load Despatch Center (MSLDC) and Manikaran Analytics Limited for the removal of hurdles from the provisions of the MERC (Forecasting, Scheduling and Deviation Settlement for Solar and Wind Generation) Regulations, 2018, and its implementation.
In this case, the respondents were Maharashtra State Electricity Distribution Co. Ltd (MSEDCL) and Maharashtra State Power Generation Co. Ltd (MSPGCL).
Due to the similarity of all the 43 cases, the commission heard them together on August 22, 2019.
The commission has considered a few issues to be addressed in the order based on various problem areas raised before it, which are as follows:
Registration of the Qualified Co-Ordinating Agency (QCA) and appointment of QCAs of pooling sub-stations where currently no entity is in position to achieve specified 51% majority.

The Commission observed that of the 102 pooling sub-stations, only 67 are registered with the MSLDC, and about 32 of them have not yet appointed/registered their QCA with the MSLDC. The Commission has asked the MSLDC to maintain and update the list of all renewable energy generators based on connectivity and synchronization permissions granted. Further, it has directed the MSLDC and distribution companies to issue notices to those renewable energy generators who have not appointed QCA and not registered the QCA with MSLDC to comply with the regulations within one month from the date of issue of this order and submit the report of pending compliances (if any) to the Commission. The Commission has also suggested limited aggregation of pooling sub-stations having installed capacity of up to 20 MW and connected to 33 kV transmission network for complying with forecasting and scheduling regulations.
The commission has directed the state transmission utility and distribution licensee, Maharashtra State Electricity Transmission Company Limited, to take on all the activities related to metering arrangements for all renewable energy pooling sub-stations. It has also granted an additional period of six months from July 1, 2019, to Jan 1, 2020, and with this, the commercial implementation of the renewable energy forecasting and scheduling regulations will commence from January 1, 2020.
During the trial period of six months, the pooling sub-stations which are already registered will continue submitting schedules to MSLDC and collection of meter data as prescribed. MSLDC will continue implementing all the activities including, scheduling of renewable generation, computation of absolute error, renewable deviation and renewable energy deviation charges, preparation of mock renewable energy DSM (Deviation Settlement Mechanism) bills. MSLDC will publish the renewable energy schedule, energy accounting statement and DSM Statement (including mock DSM bills) on its website for each QCA and every pooling sub-station, separately. These bills would be issued to QCAs; however, QCAs shall not be required to pay the DSM charges against these DSM Bills during the trial period of six months from July 1, 2019, up to December 31, 2019. Further, QCAs will continue de-pooling of the renewable energy DSM charges among the generators for their respective pooling sub-stations, but no commercial transactions will take place.
In March 2019, <a href="https://mercomindia.com/maharashtra-scheduling-forecasting-solar-wind/" target="_blank" rel="noopener noreferrer">Mercom</a> had reported that MERC had exempted renewable energy qualified coordinating agencies for meter reading, data collection, and communication from pay scheduling and forecasting charges. However, the initial corpus that QCAs must deposit remained unchanged.
<a href="https://mercomindia.com/qca-maharashtra-pay-25000-mw-solar/" target="_blank" rel="noopener noreferrer">Initially</a>, the QCAs had been asked to deposit ₹25,000 (~$357.6)/MW as a corpus for solar and ₹50,000 (~$715.6)/MW for wind projects. Mercom had reported back then how Maharashtra was behind when it came to meeting renewable purchase obligation (RPO), and these new added costs could inhibit large-scale project development.

Maharashtra To Launch Renewable Energy Deviation Settlement Regulations from Jan 2020

Mrs. Aishwarya Rai Bachchan along with Relishah Export (RM) and Classic marble Company Private Limited (CMCPL), have jointly filed a case with the Maharashtra Electricity Regulatory Commission (<a href="https://www.merc.gov.in/" target="_blank" rel="noopener noreferrer">MERC</a>) against the <a href="http://www.mahadiscom.in/" target="_blank" rel="noopener noreferrer">Maharashtra State Electricity Distribution Company Limited</a> (MSEDCL) for the delay in payments towards the power generated from wind energy projects.
Similarly, Vostok (Fareast) Securities Private Limited (VFSPL), Silverline Investment Company Private Limited (SICPL), and Bengal Cardboard Industries &amp; Printers Private Limited (BCIPPL), have also filed petitions against MSEDCL for the same reason.
All six petitioners are wind power generators.
The commission has directed MSEDCL, the respondent, in this case, to reconcile the statement of accounts with the petitioners within two weeks and intimate the date by which the payment would be made.
The MSEDCL owes a total sum of ₹30.24 million (~$0.423 million) to the six wind generators.
The commission noted that MSEDCL made the payments of the outstanding principal amount and delayed payment charges as claimed by the petitioners in their original petitions. It also stated that MSEDCL has started paying some amount including late payment charges which were due to be paid to the wind generators after the original petition, but, there is still some amount pending for payment.
The Commission has now ordered the MSEDCL to note that if the payment is further delayed, penal interest of 1.25% per month on the late payment charges will have to be paid.
In May 2019, Mercom had <a href="https://mercomindia.com/merc-warns-msedcl-wind/" target="_blank" rel="noopener noreferrer">reported</a> that MERC reprimanded MSEDCL for the continued delay in meeting payment obligations to independent power producers, including delayed payment charge, and for disregarding the previous orders of the commission.
The state has been struggling to meet its solar and non-solar renewable purchase obligations (RPOs) and has been issuing tenders to procure <a href="https://mercomindia.com/maharashtra-tender-solar-projects/" target="_blank" rel="noopener noreferrer">solar</a> and <a href="https://mercomindia.com/maharashtra-wind-energy-tariff-cap/" target="_blank" rel="noopener noreferrer">wind</a> energy to meet the obligations. The tariff caps and the questionable creditworthiness of the DISCOM have earlier seen a <a href="https://mercomindia.com/maharashtra-ag-feeder-solar-retender/" target="_blank" rel="noopener noreferrer">tepid</a> response for the tenders issued.

Maharashtra Commission Asks DISCOM to Settle Dues of Wind Power Generators

The <a href="http://www.mahadiscom.in/" target="_blank" rel="noopener noreferrer">Maharashtra State Electricity Distribution Company Limited</a> (MSEDCL) has filed a petition before the Maharashtra Electricity Regulatory Commission (<a href="https://www.merc.gov.in/" target="_blank" rel="noopener noreferrer">MERC</a>) seeking its approval for the procurement of 500 MW of flexible and schedulable power to fulfill its Renewable Purchase Obligation (RPO).
The MSEDCL wants to procure the power from renewable energy sources along with energy storage facilities for a period of 25 years. The petitioner also seeks the approval of tender documents.
MSEDCL has stated that it has already contracted 9,852 MW of renewable power as on March 31, 2019, and has planned to contract around 8,000 MW of renewable energy especially solar power to meet its RPO targets. By FY 2021-22, around 16,500 MW of renewable power is expected to be fed into the grid, says the petition.
In the petition, the MSEDCL has added that it is facing difficulties in purchasing Renewable Energy Certificates (RECs) due to the non-availability of adequate quantity of RECs and their increased rates in the market.
“In such a scenario with increasing targets of RPOs on a year-to-year basis, it is necessary that MSEDCL should contract sufficient renewable power through long-term contracts,” states the petition.
It further mentions that whenever there’s low availability of power from contracted generation due to the shortage of either fuel or water or for cost optimization purposes, then power is purchased from the market to meet the consumers’ demand.
“Also, contracted renewable generation for meeting RPO is available during a certain period of the day and is not available round the clock,” MSEDCL states.
The MSEDCL suggests that for the integration of large amounts of renewable energy power into the grid, shifting of agricultural load during the daytime to solar power and  supply of electricity with changed demand pattern will be required. Therefore, to fulfill the RPO target and to meet modified demand pattern, MSEDCL has proposed to procure flexible and schedulable power from renewable source with storage facility on long-term basis for 25 years.
The flexible and schedulable generators may inject power either through renewable generation or pumped storage or batteries. “The construction of these projects may take around three to four years and will be available after FY 2021-22 if the process is initiated now,” states the petition.
Considering the various aspects of such flexible generation, MSEDCL intends to procure 500 MW of flexible generation from renewable sources along with the energy storage system through the competitive bidding process which will also support MSEDCL to fulfill its RPO targets.
The MSEDCL has also prepared tender documents (Request for Selection and draft PPA) for the procurement of power from flexible, schedulable power generators on a long-term basis from renewable energy sources.
The commission has noted that there are deficiencies in the tender document submitted by MSEDCL and there’s no clarity on the location or co-location of the energy storage project.
The commission has ordered MSEDCL to rectify all the deficiencies and errors in its RfS document and refer to the tender document of the Solar Energy Corporation of India issued on a similar concept.

In this tender, a project should have at least two components. One will be the energy storage system component, and the other will be the renewable energy generating component. The RE generating component can be either a solar photovoltaic (SPV) system or a wind energy system or a hybrid system of both technologies.
MSEDCL <a href="https://mercomindia.com/msedcl-wind-expired-agreements-rpo/" target="_blank" rel="noopener noreferrer">has filed a petition</a> with the MERC seeking its approval to procure power from wind projects whose energy purchase agreements (EPAs) have expired to fulfill its RPO.
After falling short of its solar RPO target, and been warned by the MERC to comply with it. In <a href="https://mercomindia.com/maharashtra-discom-allowed-time-solar-rpo/" target="_blank" rel="noopener noreferrer">March</a>, MERC had issued an order to MSEDCL to comply with the solar RPO requirement for FY 2017-18 by March 2020.
